Further to our previous correspondence and meeting, we would like to provide you with an update on the implementation of new tobacco control measures. As members may recall, following the passage of the Tobacco Control Legislation (Amendment) Ordinance 2025 last year, a series of new measures have been implemented in phases.
Among these measures:
- the increased penalties for illicit cigarettes and the prohibition on the provision of smoking products to persons under the age of 18 took effect on 19 September 2025;
- the extension of statutory no smoking areas, the ban on smoking while queuing, and the increase in fixed penalty for smoking offences from HK$1,500 to HK$3,000 took effect on 1 January 2026; and
- the prohibition on the possession of specified alternative smoking products (ASPs) in public places will take effect on 30 April 2026.
Specified ASPs include, for example, e-cigarette liquids/cartridges, heat sticks, and herbal cigarettes.
